A lot of things that have happened in the last 6 years have not happened in modern history. They have shown that not many people, especially the government give a flying fuck about what should and shouldn't happen because of some code of conduct.
Sure, the person who leaked this will be fired, but I doubt they care if they are. I'm grateful that they alerting the world early to what we knew was coming. Give us a bigger head start in doing what needs to be done and working harder to make sure abortion remains legal.
Whoever they are, they are a national hero.
Maybe not. I've seen a lot of takes that suggest this did nothing to help the minority and only forces the hand of those voting to overturn because it will be obvious if they "cave" to public pressure. I don't think we can really say for sure either way.
LOLOLOL that those idiots really believed what those lying fuckers told them.
You really shouldn’t be a senator if you’re that naive.
My sister, who has worked in health care policy her whole 20 year career so far, told me the other day "Elected office is for suckers and narcissists" and I'm beginning to think she's on to something there. lol!
Per Axios Sen. Susan Collins (R-Maine) — who voted to confirm Justices Brett Kavanaugh and Neil Gorsuch — said it would violate promises they'd made to her during the confirmation process. Sen. Lisa Murkowski (R-Alaska) — who voted to confirm Gorsuch and Justice Amy Coney Barrett — said the draft "rocks my confidence" in the Court.
----------- Any chance getting their vote on tossing the filibuster and codifying roe?
Aside from the fact that they'd never vote to end the filibuster, there's also the problem of Senator Bob Casey (PA), the last "pro-life" Democrat. He'd never vote to codify Roe.
I agree it’s a long shot to get them on board Re: filibuster. But, we wouldn’t need Casey’s vote if we had Collins and Murkowski. Plus We’d have Sinema even if she didn’t vote yes on tossing the filibuster.

Not all women have a uterus, and not everyone who has a uterus is a woman, and it’s important to acknowledge that these oppressions at the hands of conservatives are experienced differently but in pain with us. .
Fuck the following: Kennedy, Trump, all Trump supporters, white women, Kennedy, Kavanaugh, Collins, Coney Barrett (sp), Kennedy, Reagan, the conservatives on this board who called us hysterical for a decade because Republicans were not marching toward extremism, Roberts, McConnell, Manchin, all Republicans, also Scalia for dying in the first place, et al. ad infinitum.
For anyone who hasn’t read the draft, here is a Sparknotes of Alito’s greatest hits:
-“We rule that Roe and Casey must be overruled” -Roe was an “abuse to judicial authority” -The “factual findings” of Mississippi that only 6 countries perform elective abortions after 20 weeks (because now we care about emulating other countries) - a scientific analysis of fetal fingernails -12th century English abortion law -anything that is a right in America must be a longstanding part of our history and tradition (so now you can indeed cue the official dismantling of interracial marriage and LGBTQ marriage or women's rights or rights of minkritized people since they are not a long-standing tradition or history) - speaking of things that have a long-standing tradition in America, we do indeed have “An unbroken history of prohibiting abortion on pain of criminal punishment” so presumably we can go back to that now! -“This Court has long disfavored arguments based on alleged legislative motive“ so we don’t give a goddamn if a law was passed with any discriminatory intent and also, would “hundreds of lawmakers” really do something dastardly like vote for something based on discrimination? -“These attempts to justify abortion through appeals to a broader right to autonomy and to define one's ‘concept of existence’ prove too much” so fuck your autonomy -Actually, saying you have autonomy at all to have an abortion “could license fundamental rights to illicit drug use, prostitution, and the like.” Footnote here notes that that slippery slope was not taught in Amy Coney Barrett’s Catholic schools since logical fallacy was deemed Critial Race Theory -he specifically designated 2 genders because people get excited about ultrasounds where they can see their “son or daughter” —and also that excitement is a reason to rule in favor of Mississippi because technology.
-“Some have argued that a fetus should not be entitled to legal protection until it acquires the characteristics that they regard as defining what it means to be a ‘person.’ Among the characteristics that have been offered as essential attributes of ‘personhood’ are sentience, self- awareness, the ability to reason, or some combination thereof. By this logic, it would be an open question whether even born individuals, including young children or those afflicted with certain developmental or medical conditions, merit protection as ‘persons.’ “ Note that we are not interested in whether women are considered “persons” and that abortion is totally the same as killing a living person with a disability and there is no difference no false analogy happening here whatsoever -^^that establishes fetal personhood 🥳 -“Undue burden” was never defined in Casey so it is confusing to us and therefore means that we should say fuck the whole thing and place any burden y’all want on abortion because it’s too hard to decide what undue means since they cite Kavanaugh‘s calendar that he had to miss that week in school -women are fine, they can vote, if they don’t like this they have tons of political power. More women are registered to vote in Mississippi than men so we are post-sexism too! -oh, and women get insurance and time off so pregnancy is no problem— look how times have changed and eMplOyeRs aRe MaGnaNiMoUs 🥰 -Roe was “damaging” because it made people sad and fight, so now we won’t fight anymore because we fixed it 🎉 -D&E procedure is officially “barbaric” per the soooper scientific findings of Mississippi and even dangerous to mothers (which we suddenly care about!) and that means Mississippi has “legitimate interests” and “a rational basis” and so, off with Roe’s head. -there is no actual right to this kind of privacy, that’s a fiction and “raw judicial power” -a convenient list of other similar findings as a nice trail of breadcrumbs for what’s next (Obergefell, Loving, Griswold, Meyer)— but those aren’t the ones we mean, swearsies!!!! Goony oath! -laws governing health are “strongly” presumed to be benevolent and legitimate -a handy appendix how-to guide detailing all the criminal penalties that we have historically applied to women who get abortions, abortion assistants, and witches— ranging from 7 years to fines to solitary confinement and hard labor. -“it is so ordered” Under His Eye
There may have been a line eliminating the 14th amendment altogether but it got lost in the middle of putting Ginsburg’s name in his mouth
Oh and originally, Mississippi asked the Court to review its Gestational Age law (the 15 week ban) but when the American people had a right to have a say their next Supreme Court Justice again (after they’d already voted in October) and Republicans stole another seat, the Court then let Mississippi change their request from the GA law to reverse Roe totally. But that is probably just a cosmic coincidence.
Conservatives are literally now calling the leak (which Ginny Thomas probably did) an “insurrection” and just like that, they care about insurrection!

TBF, the court could've just done this on their own if they wanted to anyway.
As the Supreme Court gears up to dismantle Roe v. Wade, Rep. Matt Gaetz (R-FL) points out that the women who take issue with losing their abortion rights might just have too many brains in their girl heads.
“How many of the women rallying against overturning Roe are over-educated, under-loved millennials who sadly return from protests to a lonely microwave dinner with their cats, and no bumble matches?” the GOP congressman tweeted on Wednesday, referring to the Bumble dating app.

I'm not convinced of this. It could have been a right-winger seeking to make the court look bad and thus prejudicing all their rulings. Well, all that didn't go the way they wanted. See? They're political so obamacare is illegal. They're political, so they never should have ruled on voting rights violations (rip to those rights).
I agree it's led to a groundswell of outrage and support for these basic rights, but there may be another motive. I don't trust those fuckers

This deserves a very slow clap that leads to a roaring applause.
basilosaurus, quite a few people that have worked for the Justices in the past agree with you. But what they think is that it was leaked by a conservative in order to lock down this vote. There may have been a bit of dissent and now, the judges that are more conservative will feel they have to move forward.

Yet another legitimate possibility all of which ends with me saying fuck those motherfuckers.
I know they don't have an ounce of integrity (why are there 2 men who've abused/harassed women ruling on this? Oh, yeah, patriarchy). If they had an atom of it, they might wriggle out with a will of the people defense. Although, that's also not appropriate for supposedly impartial judges. Will of the people is bullshit to keep majority in control of minority. [edit I have know idea what I meant and believe it was multiple thoughts that got put into one] Or majority in power if not numbers in control of everyone else.
Say hello to our new white landed male overlords from the right countries. The boys are back in town!
I'm holding on to a shred of hope that Roberts is so embarrassed by all of it, the leak, the rage against, he might actually rein them in. But I wouldn't put money on that happening.

See, e.g., Citizens United
No comment on Ginny Thomas? 😝
I have no memory of CU. Seriously. Did they not ask in their cert claims to reverse precedent but then later ask for that in briefing just as happened here? 🥴

Nah, I think it was most likely a Roberts clerk.
Citizens United was an electioneering case about a non-profit that wanted to show an anti-Hilary Clinton movie and whether that would violate the Campaign Reform Act.

Also, Biden sucks. I think he’s only said the word abortion once or twice. Even if legally the democrats can’t do anything you can still speak out strongly. I’ve heard from several groups that the administration won’t even meet with them. This is a crisis (and has been a crisis).
I was reading some pieces about how SHOCKED the general public is that these justices and the courts wouldn't be 100% neutral. And it just goes to show how little people pay attention until it's too late.
kinda reminds me of how shocked we all were when Trump won.
I really don't understand or even think it's constitutional to bar someone or charge them for crossing state lines to get their medication. But with this fucking court, does it really matter?
This part also enrages me. I don't think we can overcome such a schism. It's going to be a constant tit-for-tat between blue and red states not just about abortion, but every other issue.
States that support abortion rights are mobilizing to block such efforts...Connecticut just passed a bill that would prevent abortion providers from being extradited to other states, bar Connecticut authorities from cooperating with abortion investigations from a patient’s home state and allow Connecticut residents who are sued under another state’s abortion provision to countersue.
I would think that the commerce clause indicates that travel between states for goods and services is a federal issue and not subject to state law. But I am not a lawyer and I know these fuckers don't actually care about the Constitution.
So, I am not a US citizen, but I live here, so this impacts me.
And I have been in a bit of a daze about it. I can't contribute to political campaigns, and I can't vote, and, being a non-citizen, I need to exercise caution regarding what and how I protest. I feel pretty darn voiceless.
But! Today I realized one place I do have a voice... with my employer...
My employer supports a PAC. And, unsurprisingly, many of their contributions are to Republicans. (Not all, but, most.) So, today I wrote to the PAC and asked if they plan on considering any of the corporate DEI efforts when determining future contributions. Because in light of the leaked opinion, the DEI concerns should play a role.
And, I wrote to HR and asked if they were going to announce financial assistance for employees that need to travel for abortion care, once the opinion is officially released. For the company to compete in the current talent market, and to maintain its DEI chops, they really ought to make that announcement soon.
I don't really expect anything to come of it. My employer is pretty dang conservative, all considered, but... at least it is something I can do. One voice asking questions may get some more folks to contemplate it.
Been thinking about this because Democratic messaging is just always horrible and messaging about abortion is stagnant and unhelpful. “my body my choice” 1) isn’t cutting it 2) sounds self-centered, IDK, like it’s going for individualism but doesn’t convey the actual complexity of anything.

Especially now that it's also been usurped by the antivax crowd. I'd prefer something else for that reason too.

The one constant (besides Susan Fucking Collins) is that the D messaging is usually hot fired garbage. Imani Gandy (who is a repro justice-focused journalist, if anyone hasn't run across her) has recently changed her pinned tweet, but for a long time, it read something like, "I'm gonna write an article titled, 'Abortion is Healthcare', and the body will just read 'Motherfuckers.'" Clear, succinct, and announces just how tired we all are of the fuckery.
Susan Collins a NO on D bill to codify abortion rights. Says it’s too broad and “doesn’t protect the right of a Catholic hospitals to not perform abortions. That right has been enshrined in law for a long time.” She voted against similar bill in Feb. The bill will stall next week
Louisiana lawmakers have advanced a bill that would abolish abortion in the state, grant constitutional rights to "all unborn children from the moment of fertilization" and classify abortion as a homicide crime.
…
It appears to permit the prosecution of anyone who has an abortion or performs an abortion on homicide charges, opponents of the bill said.
"What this bill does is to specifically amend the crime of homicide and the crime of criminal battery to enable the state to charge people, including the pregnant person - the pregnant mother - at any stage of gestation," Ellie Schilling, a Louisiana lawyer who represents reproductive health care providers, said during Wednesday's committee hearing.
The bill's text says the state should enforce the law "without regard to the opinions and judgments of the Supreme Court of the United States" on abortion, which Schilling said "would completely annihilate" the Supreme Court's overriding authority.
ACLU of Louisiana advocacy director Chris Kaiser said the measure also would criminalize in vitro fertilization and various forms of birth control by defining a fertilized egg before implantation as a person. In a statement on Thursday, he called the bill "barbaric."

I’m glad all of this is getting attention, but unfortunately as we can see with what’s happening, the outrage is a little too late unfortunately. Bills like this have been getting thrown around and passed through certain legislatures for years. They typically die at some point, but pieces make it through, hence why access has been really really shitty in many places for years.
I feel like more people started to wake up/understand what was happening when SB8 passed in TX, but it’s not like that bill just popped up out of nowhere.
